Background
The Evidence Management System for Court Cases is a software solution designed to streamline the handling, storage, and retrieval of evidence in legal proceedings. This system aims to enhance the efficiency, security, and accessibility of evidence for legal professionals involved in court cases.
Evidence is defined under Section 3 of the Indian Evidence Act, 1872 as oral statements made by the witnesses and documents produced in the court.
Evidence may be of 2 kinds: Submissions as part of case proceedings (during case filing or the case). It is for the Judge to decide which submissions are to be considered evidence.
Oral Evidence: This may be affidavits submitted during the proceedings of the case or statements made by Witnesses
Witness depositions: Witnesses can submit their statements in 2 ways: 1) Provide an affidavit and 2) Present themselves in court. In this case, their statement is recorded by the stenographer and signed by the witness.
Other parties may submit written evidence in the form of an affidavit.
Physical Evidence: Physical evidence refers to tangible objects or materials that can be presented and examined in a court of law to support or refute a legal claim. This type of evidence is also known as real evidence or material evidence. In case physical evidence is provided to the court, the court staff will be able to upload scanned/image versions of these against the case file.
